Achinstein, Putnam, and others have urged the rejection of the received view on theories (which construes theories as axiomatic calculi where theoretical terms are given partial observational interpretations by correspondence rules) because (i) the notion of partial interpretation cannot be given precise formulation, and (ii) the observational-theoretical distinction cannot be drawn satisfactorily. I try to show that these are the wrong reasons for rejecting the received view since (i) is false and it is virtually impossible to demonstrate the truth of (...) (ii). Nonetheless, the received view should be rejected because it obscures a number of epistemologically important features of scientific theorizing. I show this by sketching an alternative analysis which reveals some of these features and gives a more faithful picture of scientific theorizing. (shrink)

Theories of epistemically justified belief have long assumed individualism. In its extreme, or Lockean, form individualism rules out justified belief on testimony by insisting that a subject is justified in believing a proposition only if he or she possesses first-hand justification for it. The skeptical consequences of extreme individualism have led many to adopt a milder version, attributable to Hume, on which a subject is justified in believing a proposition only if he or she is justified in believing that there (...) is testimony in favor of the proposition deriving from a reliable source. I argue that this Humean individualism also leads to skepticism in a wide range of cases; it makes it impossible for a layperson to be justified on expert testimony. In addition, I argue that the apparent motivation for the Humean view, an insistence on intellectual autonomy in justification, does not succeed in motivating it. I then explore the contours of a collectivist view of justification on testimony, with special attention to the place of a subject's intellectual autonomy in such justification. I try to bring empirical results of the psychology of persuasion to bear on the epistemological issues. (shrink)

Derek Parfit est célèbre pour avoir soutenu que l'identité personnelle ne comptait pas pour déterminer la survie d'une personne. Sa phrase « personal identity is not what matters » est inspirée d'une approche réductionniste de l'identité personnelle qui consiste à dire que la personne humaine se réduit à un corps, un cerveau et une série d'événements mentaux causalement liés. Dans cette optique, ce qui compte, c'est la continuité psychologique. Cet article vise à montrer que dans des dynamiques de reconnaissances, l'identité (...) personnelle peut compter dans la définition de l'identité personnelle à travers le temps ; en deux mots, que l'identité personnelle compte. Partant des conceptions narrativistes défendues par Paul Ricoeur et Charles Taylor, j'en viens à défendre une théorie constructiviste-institutionnaliste de l'identité personnelle qui prend en considération le caractère institué et construit de l'identité personnelle. Le but de cet article est donc de défendre la thèse selon laquelle l'identité personnelle compte pour dans les réflexions éthiques et politiques. (shrink)

Translators and commentators find difficulty in offering non-Greek equivalents for hekôn/hekousion and akôn/akousion. In English we do not speak of ordinary human acts as being either voluntary or involuntary. We do not say ordinarily that Jones brushed his teeth voluntarily, for that would falsely suggest that his brushing his teeth was not at all ordinary. But this conforms with ordinary Greek usage as well.

Two kinds of causal inference rules which are widely used by social scientists are investigated. Two conceptions of causation also widely used are explicated — the INUS and probabilistic conceptions of causation. It is shown that the causal inference rules which link correlation, a kind of partial correlation, and a conception of causation areinvalid. It is concluded anew methodology is required for causal inference.

Law’s ‘normativity’, its capacity to impose obligations, is among the great mysteries of jurisprudence; or so the bulk of the literature dedicated to the topic strongly suggests. As mysteries typically do, the mystery of law’s ‘normativity’ derives from various sources. One of them is the question as to the interrelation of facts and norms.

It is widely thought that knowledge is factive – only truths can be known. However, this view has been recently challenged. One challenge appeals to approximate truths. Wesley Buckwalter and John Turri argue that false-but-approximately-true propositions can be known. They provide experimental findings to show that their view enjoys intuitive support. In addition, they argue that we should reject the factive account of knowledge to avoid widespread skepticism. A second challenge, advanced by Nenad Popovic, appeals to multidimensional geometry to build (...) a case where it seems intuitive that a person knows p even though p is false. In addition, Popovic argues that we should reject the factive account of knowledge because most of us would not become widespread skeptics if we discovered that ordinary objects in our world are actually four-dimensional. In this paper, we defend the factive account of knowledge against these arguments by challenging the intuitive appeal of the cases and arguing that there is no real threat of widespread skepticism for the factive account of knowledge. In her paper entitled "Causal Laws and Effective Strategies" (1979), Cartwright sets out to establish the connection between laws of association and causal laws. In part Cartwright is trying to show the sense in which a cause increases the probability of its effect, and to explain what causal laws assert by giving an account of how causal laws are related to certain kinds of statistical laws. In section II we explicate the essential features of Cartwright's for- mulation and in section (...) III we argue that there are several reasons for believing that Cartwright's formulation is inadequate and must be rejected. Nonetheless, we believe Cartwright's formulation does contain two key insights into the nature of causation. In section IV we use these two insights to sketch out the key features of an alternative formulation that holds the certain laws of association are necessary conditions for causal laws. The alternative formu- lation, we believe, explains what it means to say a cause increases the probability of its effect. (shrink)

Ambiguity associated with everyday practice of science has made it difficult to reach a consensus on how to define misconduct in science. This essay outlines some of the important ambiguities of practice such as distinguishing data from noise, deciding whether results falsify a hypothesis, and converting research into research publications. The problem of ambiguity is further compounded by the prior intellectual commitments inherent in choosing problems and in dealing with the skepticism of one's colleagues. In preparing a draft code of (...) ethics for the American Society of Biochemistry and Molecular Biology (ASBMB), an attempt was made to take into account the ambiguities of practice. Also, the draft code adopted trust as its leading principle, specifically the importance of trust as a condition necessary for there to be science. During revision of the code, the focus on trust was changed. The new orientation was on trust as a consequence of carrying out science responsibly. By addressing the obligations necessary to engender trust, the ASBMB ethics code not only sets professional standards, but also makes a clear statement of public accountability. (shrink)
